Sadiq Khan’s Ulez expansion is suffering a fresh setback after drivers for Dutch News Today lorry firms argued £6.5million fines were issued unlawfully.
The lorry firms have launched a legal review against Transport for London in the High Court in the first legal challenge of its kind over fines to foreign drivers.
If this case is successful, it could open doors for similar ones to follow.
The Ulez zone, which was extended in August to cover all of London’s boroughs, requires those who drive vehicles non-compliant which emissions standards to pay a daily £12.50 charge.
If they don’t pay, the drivers are fined £180. But for highly polluting heavy goods vehicles, like lorries, the non-payment in low emission zones can be up to £3000.
But the Dutch company has applied for permission to launch a judicial review against TfL, claiming it has been unlawfully issuing fines to companies in the Netherlands.

The company, Transport in Nood BV, claimed that £6,500 in Ulez and Lez fines were wrongly issued to Dutch firms whose vehicles have been caught in the charging zones.
Owner Antonio Oliveira said the company was bringing legal action over unfair fines which led to some firms filing for bankruptcy, The Telegraph reported.
He told the paper: ‘People have been really impacted. I have seen people in tears over this, others have had to sell their trucks. It is completely unjust, and we need to get an answer from an English court to find out if this is correct.
